Controlled Digital Lending

PCI Webinar with Sara Benson

Controlled Digital Lending

In the pandemic, many libraries took advantage of Controlled Digital Lending (CDL) through the Hathi-Trust Emergency Temporary Access Service. CDL is based on an extension of the right of first sale combined with fair use principles.

This webinar will provide the basics of CDL, how the Hathi-Trust ETAS utilized CDL during the pandemic and how many libraries have built their own version of CDL, including the University of Illinois, post-pandemic.

In this webinar, participants will learn:

  • How controlled digital lending is legally justified
  • Why the Internet Archive was sued for engaging in digital lending
  • Ways to distinguish the work of Hathi-Trust from the Internet Archive
  • Paths toward legally engaging in controlled digital lending
